2023 aFe POWER MAP (Minimum Advertised Price) Policy

Introduction:

- To protect the stability and profitability of the aFe POWER (advanced FLOW engineering) product line, all resellers must be an approved aFe POWER Authorized Dealer and are subject to our MAP (minimum advertised price) policy even if they do not buy directly from advanced FLOW engineering.
- Additionally, resellers engaged in selling aFe POWER products who require use of aFe POWER intellectual property or copyrighted material such as product data and images for use in advertising and on the internet will require an Intellectual Property and Copyright Information Authorization for Trade and Ecommerce from aFe which is subject to MAP compliance.
- We actively enforce reseller adherence to MAP pricing, so please be sure that the individual(s) responsible for MAP compliance in your organization are aware of this policy.

Policy Details:

All products must be properly displayed for retail sale with aFe brand name and MAP price. MAP pricing is published in our jobber price sheet. In the event MAP is not explicitly published then MAP will be jobber price. aFe POWER chooses not to participate in any retail marketing techniques employed for the purpose of circumventing this MAP policy or displaying a final selling price of aFe POWER products below MAP. aFe POWER considers use of those techniques a violation of this policy. Such techniques are including but not limited to:

Use of coupons or redemptions that eventually display a final selling price of aFe POWER products below MAP;
Instant rebates;
Non-factory sanctioned rebates;
Bulk promotions;
Masking used for new;
Storewide discounts that activate with aFe POWER products alone and therefore display a price below MAP;
Ecommerce shopping cart “price too low to show” or “add to cart to show price” or “email for price”;
Automated pricing/quotes or price match;
Quantity discounts;
Violating MAP during particular hours or in particular regions;
Cloaking;
Aliasing accounts; or
Listing aFe POWER products without minimum authorized information.

Tracking:

We proactively track details and frequency of MAP violations on a weekly basis. Violators are deemed wholly in violation regardless if other venues or part numbers are in compliance. According to California law, aFe POWER is in no way obligated to prove the violation, participate in its repair, or prove reseller compliance. aFe POWER shall not bear the burden of compliance.

Violators will be notified of the violation and will be given 5 business days to correct.
Failure to correct results will result in a mandatory 6 month suspension, addition to our “Do Not Sell” list and the authorization to use aFe POWER intellectual property will be withdrawn. Accounts of chronic violations will be suspended or closed indefinitely. Any forthcoming copyright violations will be subject to statutory damages under federal law.
aFe POWER wholesale distributors who sell to resellers on the “Do Not Sell” list risk discount loss and/or account suspension.

Exceptions:

This policy does not apply to wholesale advertising specific to trade, apparel, promotional items, discontinued products, authorized closeouts or liquidations, or private label products.
